The Norton Sport Club Genève in cooperation with the Club des Sport Mécaniques Grand Maghreb

 

organizes under the Swiss Motorcycle Federation (FMS), the Merzouga Rally that takes place from 20th to

 

26th of October 2013.

 

This round is enrolled in the FMS calendar with the number FMS N°415./2013 and in the Open Uem/Fim

 

Europe with the NR 32/119 and has received the VISA from the FRMM (Fédération Royale Marocaine de

Motocyclisme) on the 27th July 2013

 

 

 

The Particularly regulation is written in 2 languages (Italian and French) and in case of different

 

interpretations the French version is considered valid. All other subjects or issues that are not included in

 

this Particulary Regulations or its attachments will be considered and judged by the Race Jury.

 

The round will take place according to the FMS Sports Code, its attachments, this Particulary Regulations

 

and all the complementary Regulations approved by the Jury.

 

All the additional dispositions that are not mentioned in the present PR will be announced with attachments

 

that will have a date, a number and will be signed. These attachments will be part of the PR and will be

 

posted on the Rally Official Notice Board.

 

In case of disagreement between the parts only the Sports Arbitral Tribunal of Lausanna will be competent.

ART. 3 – COMPETITORS ENTRY CONDITIONS

 

 

 

- “In order to entry every person of whatever nationality must be over 18 years old, be in possession of a

 

driving licence valid for the capacity of his bike, of a national licence Tout Terrain delivered by a National

 

Motorcycle Federation FNM linked to UEM and start permission or International Licence and Start

 

Permission or Moroccan Licence”.

 

For the competitors who don’t have a licence, it will be delivered on spot a licence FRMM 1 – events at the

 

cost of 1,000dh.

--‐ The Organization Committee has the right to refuse an entry from a competitor without being

 

 

 

obliged of giving a reason.

--‐ The maximum number of vehicles enrolled is 100 bikes/quad and 30 SSV.

 

--‐ The COMPETITOR declares to have taken note of the route of the Merzouga Rally 2013, to

 

 

 

 

understand the difficulties and the risks that this may entail. The COMPETITOR declares to

 

be aware of the security measures taken by the Organizers and to consider them fully

 

adequate for the type of competition. The competitor also acknowledges that the racing

 

competition is a dangerous activity, recognizes that the activity of a Rider is a dangerous

 

activity for which the undersigned agrees to bear all risks.

--‐ The Competitor agrees and engages to stand surely the Organizers, the EdoMossi Srl, the

 

 

 

 

FMS and FRMM, from any responsibility for damages and /or loss of any kind for injuries,

 

claims and / or damages, occurred to the competitor and/or third parts during the

 

participation in the Merzouga Rally 2013.

 

ART. 4 – ENTRY REQUEST

 

 

 

- The entry forms are available on the website www.merzougarally.com

 

- in order to be accepted, each entry request has to be accompanied by the copy of the bank transfer with

 

the name of the competitor (changing the name will cost 300 euro of penalty).

 

- During the administration checks the competitor must sign the current regulations (mentioning to have

 

read it and accepted it).

ART. 7- ENTRY CANCELLATION– WITHDRAWN – FORFAIT

 

 

 

In order to avoid any legal issues, the cancellation of an entry must be sent only by registered letter with

 

acknowledgment of receipt. In case of cancellation, the competitor has the right to:

 

- before the 15/05/2013 reimbursement of the 50% of the sum paid

 

- before the 15/09/2013 reimbursement of the 30% of the sum paid.

- no reimbursement for the notifications arrived from the 16th September 2013.

 

 

 

It will be reimbursed the totality of the paid sum only if the entry is refused by the Organization Committee

 

at the moment of the presentation of the application.

 

There will be no reimbursement if - during the technical and administration checks -a vehicle doesn’t

 

comply with the regulations and/or the competitor cannot start because his documents are not valid and he

 

cannot finalize the technical and administration checks.

 

 

ART. 8 – CANCELLATION OR CHANGE OF THE DATE OF THE EVENT

 

 

 

If the start of the event cannot take place due to several reasons such as lack of Federation permission,

 

withdrawn of the Federation permission, lack/withdrawn of authorization to ride on the territory, political

 

trouble in the country where the rally takes place that make impossible the taking place of the rally, a

 

financial issue that make impossible the technical and sports organization of the event, severe issues in the

 

transport of material or Competitors, the Organization is due only to refund the competitors with the sum

 

they have paid. The Organization is not responsible of the transport of the vehicles.

 

If the start of the event is delayed, the Organization must inform immediately about the new race calendar.

 

If a competitor cannot participate to the race due to the change of the date, he will have a maximum of 8

 

days to ask for reimbursement by sending a registered letter with acknowledgment of receipt.

 

For all other circumstances the participants cannot ask for any kind of indemnity.

 

 

ART. 9- INSURANCE

ART. 9. 1. – CIVIL RESPONSIBILITY

 

 

 

The organization has taken a sporting event Liability Insurance policy, according to the law. The guarantee

 

amount is CHF 5,000,000 per event.

 

The contract guarantees the financial consequences of the damage caused to third parties by the organizer

 

or by competitors.

 

This warranty is in effect at the time of the entry of the vehicle inside the place of technical and

 

administrative checks and ends on 26 October 2013 at 23:59. In case of withdrawal or disqualification, the

 

warranty will expire automatically at the end of the stage in question.

 

The time of this withdrawn or exclusion will be the closing CH (Time Control) at the end of the stage.

 

In case of accident, the competitor or his representative shall make a declaration in writing, no later than 24

 

hours to the race director or the responsible of competitors relations.

 

The policy herewith attached doesn’t cover:

 

1) the liability towards third parties of any non-licensed rider/driver,

 

2) the responsibility of the competitor / driver towards another competiotr enrolled in the rally .

--‐ The COMPETITOR declares to be aware of the route of the Merzouga Rally 2013, of its

 

 

 

 

difficulties and risks.

--‐ The COMPETITOR declares to be aware of the security measures taken by the Organizers

 

 

 

 

and to consider them fully adequate for the type of competition. The competitor also

 

acknowledges that the racing competition is a dangerous activity, recognizes that the activity

 

of a Rider is a dangerous activity for which the undersigned agrees to bear all risks.

 

The Competitor agrees and engages to stand surely the Organizers, the EdoMossi Srl, the

 

FMS and FRMM, from any responsibility for damages and /or loss of any kind for injuries,

 

claims and / or damages, occurred to the competitor and/or third parts during the

 

participation in the Merzouga Rally 2013.

 

 

 

The contract of Insurance do not cover the theft of vehicles, spare parts, etc..

 

In case of theft in a country crossed by the rally, no liability can be attributed to the organizer.

 

The Organizing Committee will not accept any liability for:

 

- The consequences of violations of the laws, regulations and orders of the country, committed by the

 

participants and that will only be supported by the competitors themselves.

--‐ In case of disaster, riots, demonstrations of which the competitors or the assistance could be

 

 

 

victim,the material, financial and sporting consequences should be borne by the competitors

 

themselves.

--‐ The vehicles enrolled as assistance, press, accompanist, are by no means considered Rally

 

 

 

participants and are not covered by the Insurances.

 

THESE VEHICULES ARE UNDER THE RESPONSIBILITY OF THE DRIVER.

 

 

ART. 9. 2. – VEHICLE INSURANCE

 

 

 

Competitors must have the proof of the RC Insurance and the green card and present them at the

 

administrative checks.

 

 

ART. 9. 3. – INDIVIDUAL INSURANCE MEDICAL REPATRIATION

 

 

 

For Competitors with national license issued by a federation listed on the EMU and start permission in

 

accordance with Article 110.2 of the FIM Sporting Code, this Insurance is included in the license.

 

The inscription includes also an Insurance of repatriation and medical costs of 20,000 euros issued by Ellis

 

Clowes England

 

 

The organization will be responsible for the first aid, transportation to the nearest clinic. The

 

Insurance company will take care of repatriation.

It is strongly advised to take out a supplementary Insurance repatriation with additional guarantees

 

during the verifications.

 

ART. 10- ADMINISTRATION CHECKS

 

 

 

The first session of administrative checks is scheduled for Sunday 20 October 2013 from 08:00 to 19:00 at

 

the hotel Erfoud Xaluca.

 

Each competitor will receive a notice specifying the exact time of his turn to carry out the administrative

 

checks.

 

Any delay or lack of presence will incur a penalty of 10 minutes for the first hour of delay and 30 minutes

 

for each subsequent hour and 50 euros each additional hour of delay.

 

The competitorest the ones responsible for the veracity of the documents provided.

 

No photocopies, reporting the loss or theft will be accepted.

 

Each competitor must submit during the administrative checks the following valid personal and original

 

documents:

 

- F.N.M. License and start permission

 

- Bike driving licence corresponding to the capacity of the vehicle presented.

 

- valid oassport.

 

- Authorization to ride the vehicle (if the competitor is not the owner)

 

- Proof of payment of the Entry.

 

- Gray card or registration certificate of good standing (not WW or W). Temporary registrations will not be

 

accepted (International Customs Convention).

 

- Certificate of Insurance (valid green card for Morocco)

 

 

ART. 11- TECHNICAL CHECKS

 

 

 

The 1st session of technical checks is scheduled for the 20th October 2013 from 08h00 to 19h00 at the

 

Xaluca hotel in Erfoud. The vehicles must be presented ready for the race (after the checks there is parc

 

fermé). To present the vehicle at the technical checks is considered an implicit declaration that the vehicle

 

comply with the Regulation.

 

All the vehicle that do not comply with the regulations and the rules of the event could be not authorized to

 

take the start (decision of the Jury). In this case there will be No reimbursement .

 

 

ART. 12 – IDENTIFICATION

 

 

 

An indication bracelet for the bivouac, the dinners and the prize giving will be supplied during the

 

administration checks.

 

The Organization will control regularly the identifications bracelets. At every request from the Organizer the

 

competitor is obliged to show the identification bracelet.

Any infringement will be punished with a fee of 300,00.

 

 

 

The bracelet must be hold till the prize giving.

 

During the whole rally, the Responsible of the competitors relations based at the PC Course will have some

 

spare bracelets or stickers if the competitors declare to have lost his bracelet or damaged it.

 

 

ART. 14 – ADVERTISING

 

 

 

During the checks it will be provided a bib and stickers with race number and advertising of the

 

organization.

 

The Competitor will have to leave a space to attach these stickers on his vehicle necessary. If the vehicle

 

does not have the enough free surface, the competitor will have to prepare it is to beore the scruteneering.

 

It is not allowed to change or cut the stcikers.

 

The bib cannot be modified or cut. The superior part of the rear bib will have to be situated at 20 cm

 

maximum from the neck of the competitor. No exception will be made.

 

 

Compulsory advertising :

 

 

 

 

- 1 front bib with the race nr and sponsor of the event

 

- 2 advertising stickers of the organisation

 

- 2 lateral stickers with the race nr and sponsor of the event

 

- 1 rear bib (in the integrity of its size) avec race nr and sponsor of the event .

in any moment during the rally an incorrect positioning of the advertising will be fined as follows:

 

-FIRST INFRINGEMENT: the penalty is equal to 30% of the entry fee.

 

-SECOND INFRINGEMENT: disqualification.

 

 

ART. 15 – COMPULSORY STAGES/ FIRST AID & NAVIGATION

 

 

 

At the stages, the competitor will receive a voucher that proves the participation to the stages. This voucher

 

is necessary to collect the vehicle from the parc fermé. In case the voucher is not presented there will be a

 

penalty of 1 hour and a fine of 50 euros.

 

 

ART. 16 – COMPULSORY BRIEFING

 

 

 

Every evening at 18:00, the compulsory briefing will take place, the lack of participation will be penalized

 

with a fine of 50 euro and 1 of penalty

 

 

ART.18 ASSISTANCE

 

 

 

The assistance is authorized in the common sector of the race route and the assistance itinerary.

 

There are areas available for the assistance in the CP with neutralization.

 

 

ART.19 – STARTING ORDER

 

ART.19.1 – WARM UP AND PROLOGUE STARTING ORDER

 

 

 

WARM UP- According to the race number, 1 competitor each 30 seconds.

 

PROLOGUE- According to the race number, 1 competitor each minute for the first 10 competitors and then

 

one each 30 seconds

 

 

ART. 19.2 – STARTING ORDER OF THE FOLLOWING STAGES

 

 

 

- The starting order of the first stage will be according to the provisional result of the Prologue

 

- Starting from the second stage, the start will be according to the provisional classification of the previous

 

day

 

- The competitors will start every minute.

 

 

ART. 20- OFFICIAL ITINERARY

ART. 21 -ROAD BOOK ET NAVIGATION

 

The road book is designed to indiicate to the competitors the way to go, the GPS points and the main

 

dangers. The navigation softwares are not allowed.

 

Any recognition of the course is prohibited under penalty of disqualification.

 

The road book, the descriptions of the first stage will be given to competitors during the administrative

 

checks.

 

Then the road book will be delivered daily. The information transmitted by the track openers will be

 

provided to the competitors during the briefing and attached on the notice board. Compulsory requirements

 

for the navigation are: Trip Master, unwinding road book and GPS UNIK ERTF. Any kind of problem on the

 

navigation equipment must be reported immediately to the organization. The organization is ensured that all

 

competitors are aware of the use of navigational equipment.

ART. 26 – CIRCULATION

 

 

 

THE RALLY RAID IS A DISCIPLINE ON ROADS OPEN TO TRAFFIC CIRCULATION. THE ORGANIZATION

 

DOES ITS BEST TO GUARANTEE THE SAFETY OF THE ROUTE WITH THE COLLABORATION OF THE

 

LOCAL AUTHORITIES, BUT THE ROAD ARE OPNE TO THE TRAFFIC CIRCULATION.

 

 

ART. 27– AUTONOY AND REFUELLING

 

 

 

The minimum autonomy required is 140km on every kind of terrain. The rider is the only responsible for the

 

autonomy of his vehicle and cannot complain with the organization if his vehicle do not cover the minimum

 

distance of 100 km on every kind of terrain.

It is compulsory to have a 10% additional autonomy.

 

 

 

 

The organization will provide refuelling every 140 km maximum.

 

 

 

During the selective sectors, the refuelling will be in a place where there will be a neutralization of 15 '.

 

Refueling should be done with the engine stopped. It’s authorized only the assistance between

 

competitors.

 

The organization is not responsible for the quality of gasoline supplied, that it is regularly bought at the gas

 

pump

 

 

ART. 28 – CROSSING OF THE VILLAGES

 

 

 

The speed limit when crossing a village or in the liaison is 50 km/h or less if indicated in the local boards.

 

It is indicated on the roadbook as danger the areas that are considered dangerous for the rider or the local

 

population.

 

 

ART. 29 – AUTHORIZED MAXIMUM TIME AND TIME CHECKS

 

 

 

A maximum time for each stage will be decided and marked on the time card.

 

The time controls are shown on the time card.

 

The estimated average speed between the time checks of the liaison is about 40km/h.

 

Every minute or fraction of a minute or delay or in advance will result in a one-minute penalty. The passage

 

in advance at the check of the end of the stage is allowed without penalty.

 

 

ART. 30- FIXED PENALTY

 

 

 

This penalty was created to avoid disqualification. It allows a competitor who sees this penalty inflicted, can

 

continue the race in normal racing conditions, however being severely penalized.

 

- The fixed penalty is applied, among others, in the following cases:

 

1) Absence from a Time Check, start of a special stage (DSS), arrival of the special stage (ASS)

 

2) exceeding the maximum time allowed for a section or on a selective sector.

 

- The value of the fixed penalty for each stage will be specified on the timetable of the route

 

 

ART. 31- WITHDRAWN – DISQUALIFICATION

 

 

 

In case of withdrawal, it is imperative that the competitor inform, by any means and in the shortest possible

 

time, the organization.

 

Retirement forms will be available at Start, CP, CH, Arrival or Race Direction. They must be completed,

 

signed.

 

Failure to comply with this important safety and discipline will result in disqualification.

 

 

ART. 32 - CHEQUE DEPOSIT

A deposit of 1,000.00 must necessarily be paid for each bike, by check made payable to EdoMossi Srl.

 

 

 

This deposit is the guarantee of your compliance with the following rules:

 

-Obligation to notify the organization in case of withdrawn, with all available means.

 

-Obligation to respect this regulation

 

In case of non-compliance with any of these rules the deposit will not be returned.

 

This check will be returned on 26 October 2013 to the competitors who perfectly fulfilled their obligations.

 

this deposit check has nothing to do with the deposit for the instruments for navigation and safety.

ART. 33- TRACK CLOSING

 

If necessary, a Balai vehicle from the organization will close the special stages as specified in the roadbook.

 

It will take on board the Competitors whose vehicles have been damaged or inoperable. If there is space

 

available and without any obligation, it ill also collect the bikes that are dameged or inoperable and

 

transport them to the bivouac.

Warning: under no circumstances the organization (balai or any other vehicles of the organization) will

 

 

 

recover the bikes that are out the route of the special stages as notified on the road book.

 

In the large areas, it is up to the competitor to report his presence using his survival gear.

 

No appeal may be taken against the organizers about it.

 

The Competitors CAN NOT refuse to take on board the balai vehicle.

 

No action on the consequences of this refusal can be committed against the organization.

ART. 36 -APPEALS

 

 

 

The Appeals must be presented according to the dispositions of the Disciplinary Code and Arbitrage. They

 

have to be presented in written to the Race Director in the time requested by the Code and by the

 

Competitor not a third part. Each appeal refers to only one subject and must be accompanied by a sum of

 

120 euro (see art. 4.2 du Code Disciplinaire et d’Arbitrage).
